Please read these Terms and Conditions carefully. By accessing, browsing, or using www.alquilermotorbike.com, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please discontinue your use or access to this site.

Renter Eligibility:

To rent a motorcycle from Alquiler Motorbike, the Renter must hold a valid motorcycle licence (Class B2, B, or international equivalent) appropriate for the engine class being rented, and present a valid government-issued photo ID (MyKad, passport, or equivalent) at time of collection. The Renter must be at least 21 years of age. The Renter must not be under the influence of alcohol, drugs, or any substance that impairs judgement or reaction time. Failure to meet any eligibility requirement will result in immediate refusal of rental with no refund issued.

Care of the Motorcycle:

The Renter shall ensure the proper care and maintenance of the motorcycle during the rental period to preserve its faultless condition. This includes, but is not limited to, regular checks of tire pressure, oil levels, and other essential maintenance tasks. Any issues or required maintenance should be reported to the Owner immediately.

Security and Theft:

The Renter shall securely store and safeguard the motorcycle at all times and refrain from operating it in hazardous environments. In the event of theft, the Renter agrees to assume responsibility for the full replacement value of the motorcycle. The Renter must take all necessary precautions to prevent theft, such as using locks and parking in secure areas. Theft must be reported to both the police and to Alquiler Motorbike within 6 hours of discovery.

Condition of the Motorcycle:

The Renter acknowledges that the motorcycle is rented in technically sound condition and agrees to return it in the same condition. Any defects or damages must be promptly reported to the Owner. The Renter is responsible for conducting a pre-rental inspection and noting any pre-existing damage, supported by photographs taken at time of collection.

Rental Items:

The motorcycle is rented with specified items (e.g., helmet, locks, gloves, and other accessories). All accessories issued are listed on the Rental Agreement. The Renter shall be liable for any lost or damaged items and shall be charged accordingly. Any item not returned at the end of the rental period will be treated as lost and charged at full retail replacement value, payable immediately upon return.

Mileage Tiers:

All rentals include a Standard Mileage Tier of 200 km per rental day, free of charge. Any distance travelled beyond 200 km/day will be charged at RM0.50 to RM1.00 per km, depending on the motorcycle model and engine class, as communicated at time of rental.

Renters may upgrade to the Premium Mileage Tier at the point of collection in-store. This upgrade is not available online or after the rental period has commenced.

  • Premium Tier — Small Bikes (below 160cc): +RM20.00 per rental day, includes up to 300 km/day.
  • Premium Tier — Standard & Large Bikes (160cc and above): +RM40.00 per rental day, includes up to 300 km/day.

Any distance beyond the upgraded 300 km/day allowance will attract the standard excess mileage charge. Mileage is tracked via the motorcycle's odometer at collection and return. Tampering with the odometer is a criminal offence and will result in immediate termination of the rental and may result in legal action.

Add-Ons & Accessories:

The following accessories are available for rental and must be selected and paid for before the rental period begins.

Helmet Rental:

  • Helmets are available for daily rental at rates communicated at time of booking.
  • In the event that the rented helmet is damaged (cracked shell, broken strap, visor damage, etc.) or lost during the rental period, the Renter is required to pay the full retail replacement cost of the exact same helmet model. No depreciation will be applied.
  • Cosmetic surface scratches from normal use are accepted. Structural damage is not.

Gloves Rental:

  • Riding gloves are available for daily rental. Rates will be communicated at time of collection.
  • Lost or damaged gloves will be charged at full retail replacement cost.

Motorbike Camera & Recording Gear (Coming Soon):

  • Mounted cameras and recording gear will soon be available as a rental add-on. Specific pricing and terms will be published upon availability.
  • All camera equipment will be subject to the same damage and replacement policy as other accessories — any lost, stolen, or damaged item must be replaced at full retail cost.
  • The Owner is not responsible for any recordings made using rented equipment. The Renter assumes full legal responsibility for all content recorded.

Damages:

The Renter shall be responsible for any damages resulting from improper use or negligence. The Renter also agrees to indemnify the Owner for damages caused to third parties. This includes all costs associated with repairs or replacement of the motorcycle and any legal fees incurred. The Renter agrees to pay all repair or replacement costs in full upon return. Any outstanding balance will attract a late payment charge equivalent to the full daily rental rate, applied per day until settled.

Accidents:

In the event of an accident, the Renter shall be responsible for any incurred repair costs and shall continue to pay rental fees until the motorcycle is repaired and returned. The Renter must report any accidents to the Owner immediately and follow all local laws regarding accident reporting. A police report must be filed for any accident involving third parties, injury, or significant damage, and a copy must be provided to the Owner. Photographs of all damage, the scene, and any third-party vehicles must be taken immediately and shared with the Owner.

Insurance

The Renter acknowledges that no personal health or accident insurance is provided by the Owner during the rental period. As such, the Renter waives any claims against Alquiler Motorbike Sdn. Bhd. for injuries, medical expenses, or damages incurred while operating or riding the motorcycle.

It is strongly recommended that all Renters have their own personal accident and health insurance coverage to protect themselves during the rental period.

Insurance Policy

Please note that Alquiler Motorbike does not provide personal health or accident insurance for renters during the rental period. By proceeding with the rental, the Renter acknowledges and accepts full responsibility for any injuries, accidents, or medical emergencies that may occur while using the motorcycle.

We highly recommend that all Renters carry valid personal accident and health insurance to cover unforeseen circumstances. The Renter waives any and all claims against Alquiler Motorbike Sdn. Bhd. for medical costs, injury, or loss sustained while operating the rented vehicle.

For added protection and peace of mind, Renters may choose to purchase our optional daily Insurance Coverage, which offers roadside assistance and damage protection.

Optional Insurance Coverage

Alquiler Motorbike offers an optional insurance package at MYR 10.00 per rental day to enhance peace of mind for our customers. This optional coverage is designed to reduce the renter's liability for minor damages and to provide assistance in certain scenarios, all while complying with applicable Malaysian laws and regulations.

Coverage Inclusions:

  • Accidental Damage Protection: Covers cosmetic or non-structural damage (scratches, mirrors, indicator lights, body panels) up to a total of RM500 per rental.
  • Theft Assistance: Provides compensation of up to 50% of the motorbike's value in the event of theft, provided the renter can present a valid police report and proof of lock usage.
  • Roadside Assistance: 24/7 help for flat tires, minor breakdowns, or towing within a 30 km radius of Kuala Lumpur.
  • Priority Replacement: In case of a mechanical issue not caused by the renter, a replacement bike will be offered subject to availability.

Coverage Exclusions:

  • Engine, transmission, or internal mechanical failure unless due to factory fault.
  • Damage caused by off-road riding, racing, stunts, or unauthorized usage.
  • Use under the influence of alcohol, drugs, or medications that impair driving.
  • Lost or stolen accessories (helmets, keys, locks, gloves, camera gear, mobile holders, etc.).
  • Acts of negligence or failure to adhere to local traffic regulations.

Conditions for Claim:

  • All incidents must be reported to Alquiler Motorbike within 6 hours.
  • A police report must be filed for any theft or accident involving third parties.
  • Photos of the incident and damage must be provided for any insurance claim.
  • Proof of insurance payment must be shown to validate coverage.

Important Notes:

  • This insurance is optional and can only be added before the rental period begins.
  • The fee is non-refundable once the rental has commenced, regardless of whether a claim is made.
  • This coverage does not replace mandatory third-party liability insurance as required under the Road Transport Act 1987.
  • Personal health and accident insurance are the renter's sole responsibility.
  • Optional insurance coverage does not cover lost or stolen accessories.

For full legal compliance, this policy is governed under the Contract Act 1950 and the Consumer Protection Act 1999. Your data will be handled in accordance with the Personal Data Protection Act 2010 (PDPA).

Rental Fees:

Rental fees are fixed and non-refundable, regardless of early return due to weather, illness, or the Renter's discretion. The Renter agrees to pay all rental fees upfront, and no partial refunds will be given. Any outstanding balance not settled at the agreed time shall attract a late payment charge equivalent to the full daily rental rate, applied per day until the outstanding amount is fully settled.

Late Returns:

If the motorcycle is returned more than 30 minutes after the scheduled return time, the Renter will be charged not less than the daily rental rate. This is to ensure availability for other customers and to maintain the rental schedule. If the Renter anticipates a late return, they must contact the Owner as early as possible to arrange an extension. Extensions are subject to availability and must be paid in advance.

Subleasing:

Subleasing of the motorcycle is strictly prohibited. The Renter must not allow any third parties to use or operate the motorcycle during the rental period. The Owner reserves the right to immediately terminate the rental and the Renter shall remain fully liable for any damages, accidents, or liabilities arising from any unauthorised rider.

Assumption of Risk:

The Renter acknowledges the inherent risks associated with operating a motorcycle and assumes all such risks. The Renter agrees to ride responsibly and follow all local traffic laws and regulations.

Violation of Terms:

The Renter agrees not to violate any rules and regulations specified during the rental period. Any violations may result in immediate termination of the rental agreement and forfeiture of any fees paid. The Owner reserves the right to recover the motorcycle at any time in the event of a suspected breach, without prior notice.

Cancellation Policy:

Cancellations must be made at least 24 hours before the rental period begins to receive a full refund. Cancellations made within 24 hours of the rental period will not be refunded.

Returns:

Early returns will not be eligible for a refund. The Renter must return the motorcycle at the agreed-upon time and location. Failure to do so may result in additional charges.

Refunds:

Refunds will only be issued for cancellations made within the specified period. No refunds will be issued for early returns or for rentals terminated due to violations of the rental agreement. Optional insurance fees are non-refundable once the rental has commenced.

Website Availability:

We strive to keep our website available at all times. However, we cannot guarantee uninterrupted access due to technical issues beyond our control. We reserve the right to suspend or terminate access to the website without prior notice for maintenance or updates.

Security:

Our website uses advanced security measures to protect your personal information. However, we cannot guarantee absolute security and are not responsible for any breaches that occur despite our best efforts. Users are advised to use strong passwords and safeguard their login information.

Accuracy:

We endeavor to ensure that all information on our website is accurate and up-to-date. However, we do not guarantee the completeness or accuracy of the information. The Renter should verify all details before making any decisions based on the information provided on the website.

Considerations for Malaysian Law that is applied:

1. Consumer Protection Act 1999: Ensure that all terms and conditions are clear and fair to the consumer.
2. Contract Act 1950: Ensure that all agreements made are legally binding and enforceable.
3. Road Transport Act 1987: The Renter must comply with all local traffic laws.
4. Personal Data Protection Act 2010 (PDPA): Ensure that any personal data collected is protected and used in accordance with Malaysian laws.
